Terms governing the use of SailorDesk — CV distribution platform for seafarers.

1. Service description

SailorDesk automatically finds publicly listed recruitment contact addresses of crewing agencies and shipowners, and helps seafarers submit their job application (questionnaire/CV) to those contacts on their behalf.

This is a job application facilitation service. We do not act as a crewing agency, recruiter or employer. We provide a technical service to help candidates reach employers through the employers' own published contact channels.

The scope and number of mailings depend on the package selected: Basic (1 mailing), Standard (1 mailing + cover letter), Prime (3 mailings over 21 days).

2. No guarantee of employment

SailorDesk guarantees technical delivery of your application to the recipient list. We do not guarantee any responses, interviews, or job offers from crewing agencies or shipowners.

Hiring decisions are made exclusively by crewing agencies and shipowners and are entirely beyond our control.

3. Your obligations

Provide accurate and complete information in the order form.

Ensure your questionnaire or CV does not contain false, misleading or illegal content.

Use the service only for genuine seafarer job applications. Use for any other purpose is prohibited.

You are solely responsible for the content you submit.

You confirm that any third-party information included in your CV (such as references or previous employers' contact details) has been shared with the consent of those parties, where required, and you indemnify SailorDesk against any third-party claims relating to such information.

4. Intellectual property

Your CV, questionnaire and any uploaded files remain your intellectual property at all times. By placing an order, you grant SailorDesk a limited, non-exclusive licence to use the content solely to perform the mailing service.

5. Limitation of liability

Our liability is limited to the amount paid for the selected service package.

We are not liable for: decisions or inactions of crewing agencies; email delivery failures caused by recipient mail servers, spam filters or network outages beyond our control; loss of business, income or opportunity.

This limitation does not apply in cases of wilful misconduct or gross negligence.

6. Force majeure

SailorDesk shall not be held liable for failure to deliver services caused by circumstances beyond our reasonable control, including but not limited to: SMTP blocking by email providers, DNS failures, domain blacklisting, actions of third-party infrastructure providers, or internet outages.

In such cases we will make reasonable efforts to retry the mailing or, where impossible, issue a full refund.

7. Service refusal

We reserve the right to refuse or cancel an order before the mailing has started if we have reasonable grounds to believe that the submitted content violates these Terms, contains illegal material, or is intended for purposes other than genuine seafarer job applications. In such cases, a full refund will be issued.

8. Governing law and jurisdiction

8.1. These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

8.2. If you are a consumer (Verbraucher within the meaning of § 13 BGB) with habitual residence within the European Union, the choice of German law applies only to the extent that it does not deprive you of the protection afforded by mandatory provisions of the law of the country where you habitually reside (Art. 6(2) Rome I Regulation).

8.3. The exclusive place of jurisdiction for disputes arising from this contract is the court at our place of business in Germany, where this is permissible. For consumers, the consumer protection rules of Brussels I Recast Regulation apply, allowing you to file suit either at our place of business or at your place of habitual residence.
